By accessing this website and enrolling in courses offered by Hawk Trek, you agree to be bound by these terms of use. If you do not agree with any provision of these terms, you should not use our services or access our platform.

These terms constitute a legally binding agreement between you and Hawk Trek regarding your use of our instructional services and website.

Service Description

Hawk Trek provides online language instruction through live video sessions with qualified instructors. Services include individual tutoring, group courses, business language training, exam preparation, conversation practice, and writing instruction.

All instruction occurs remotely through our proprietary platform. We do not provide in-person instruction or recorded course materials as standalone products.

Enrollment and Payment

Course enrollment requires submission of accurate contact information and completion of an initial proficiency assessment. Pricing is listed in Canadian dollars and reflects current rates, which may be adjusted with thirty days notice to enrolled learners.

Payment is required in advance of scheduled sessions. Refunds for unused sessions may be requested according to our cancellation policy outlined below.

Scheduling and Cancellation

Session scheduling is arranged between learners and assigned instructors based on mutual availability. Changes to scheduled sessions require at least 24 hours advance notice.

Sessions cancelled with less than 24 hours notice are considered completed and non-refundable. Instructor-initiated cancellations will be rescheduled at no additional cost or credited to your account.

User Conduct

You agree to use our platform respectfully and professionally. Prohibited conduct includes harassment of instructors, disruptive behavior during group sessions, sharing platform access credentials, or recording sessions without explicit instructor consent.

Violation of conduct standards may result in immediate termination of services without refund.

Intellectual Property

Lesson materials, curriculum frameworks, and platform technology remain the intellectual property of Hawk Trek and our instructors. You may use provided materials for personal learning purposes but may not redistribute, resell, or publicly share instructional content.

Session recordings, when created, are for your personal review only and may not be shared with third parties or posted to public platforms.

Technical Requirements

You are responsible for maintaining internet connectivity, compatible hardware, and updated browser software necessary to access our platform. We cannot guarantee service availability when technical requirements are not met.

Platform downtime for scheduled maintenance will be communicated in advance when possible. Unexpected service interruptions will be addressed promptly, and affected sessions will be rescheduled or credited.

Limitation of Liability

Language instruction outcomes vary based on individual aptitude, practice consistency, and prior experience. We do not guarantee specific proficiency advancement within predetermined timeframes.

Hawk Trek is not liable for indirect, consequential, or incidental damages arising from service use, including missed exam deadlines, employment opportunities, or academic requirements that depend on language proficiency.

Our total liability for any claims related to services provided is limited to the amount you paid for the specific sessions giving rise to the claim.

Termination

You may terminate your enrollment at any time by contacting our coordination team. Unused session credits may be refunded on a prorated basis, subject to our cancellation policy terms.

We reserve the right to terminate services for violation of these terms, fraudulent activity, or abusive conduct toward instructors or staff.

Dispute Resolution

Disputes arising from these terms or service provision should first be addressed through direct communication with our coordination team. We will make reasonable efforts to resolve concerns through good-faith negotiation.

If informal resolution is unsuccessful, disputes will be resolved through binding arbitration in accordance with the laws of British Columbia, Canada.

Modifications to Terms

We may modify these terms of use to reflect changes in our services or legal requirements. Updated terms will be posted on this page with a revised effective date.

Continued use of services following term modifications constitutes acceptance of the updated agreement. Material changes affecting pricing or service structure will be communicated directly to enrolled learners.

Governing Law

These terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles. By using our services, you consent to the jurisdiction of courts located in British Columbia for resolution of any disputes.
